Spouse of Permanent Resident Visa Strategy

Proving marital substance and managing status after separation

The Spouse of Permanent Resident visa is a status with no work restrictions for foreign nationals married to Japanese permanent residents. Review items are similar to the Spouse of Japanese National, but since the PR holder has not naturalized, the PR's own residence management (risk of PR cancellation, etc.) also indirectly affects the application.

Who this is for: Foreign nationals married to Japanese permanent residents. Biological children of PRs are also eligible (if born in Japan, apply simultaneously at birth).

Case-by-Case Review Points & Strategies

Case 1: Marriage to PR — Certificate of Eligibility Application

Low Risk

Situation

A foreign national living abroad marries a Japanese permanent resident and comes to Japan to obtain a spouse visa

Strategy

Prepare similar documents as for the Spouse of Japanese National. Copies of the PR holder's residence card, resident record, and withholding tax slip are required. Prepare photos, chat records, and mutual visit records showing the relationship history.

Key Point: If the PR holder's own residence compliance (tax and social insurance payments) is poor, it may affect the spouse application. Check the PR holder's compliance status before applying.

Case 2: Handling Status After PR Spouse's Death or Divorce

High Risk

Situation

The spouse (permanent resident) of a Spouse of PR visa holder dies or divorces

Strategy

① In case of death: Within 6 months of death, consider changing to Designated Activities (Designated Activities Notice No. 46) or Long-Term Resident. ② In case of divorce: Apply for Long-Term Resident or work visa within 6 months. Changing to Engineer/Humanities is smoothest if there is work history.

Key Point: There is a provision that 'if the activities as a spouse are not conducted without legitimate reason for 6 months or more, the residence status is cancelled.' Report the facts of death or divorce to immigration promptly.

Common Mistakes & Pitfalls

1

If the PR holder is at risk of permanent residency cancellation due to unpaid pension or resident tax, it may also affect the spouse's renewal. Regularly checking the PR holder's compliance is important.
