The Family Stay visa is available to the spouse and children of foreign nationals holding a work visa (Engineer/Humanities, Specified Skilled Worker 2, etc.) or cultural activities visa. Since it depends on the supporting person's status, prompt action is needed if the supporter returns home or loses their job. Work up to 28 hours per week is permitted with a part-time work permit.

Case 1: Dependent Family of Engineer/HSP Holder (Calling from Abroad)

Situation

A work visa holder in Japan calls their spouse or children from abroad to obtain a family stay visa

Strategy

Gather the supporter's (Japan-side) employment certificate, withholding tax slip, and resident record. The dependent (overseas side) needs identity documents (marriage certificate, birth certificate, etc.) and passport. The review is smooth if the supporter's monthly income is ¥250,000 or more.

Key Point: If the supporter's income is low (below ¥200,000/month), there may be doubt about financial capacity to support dependents. Supplement with a bank balance certificate or attach a statement explaining the income outlook.

Case 2: Impact on Status When Supporter Loses Job or Returns Home

High Risk

Situation

The work visa holder (supporter) in Japan becomes unemployed or returns home, leaving the family stay spouse's status in limbo

Strategy

① If the supporter is between jobs: Changing to Designated Activities (job hunting) provides up to 3–6 months of grace. ② If the spouse meets work visa requirements: Consider changing to Engineer/Humanities, Specified Skilled Worker, etc. ③ In case of divorce: Consider changing to Long-Term Resident or Spouse of PR status.

Key Point: The family stay visa is linked to the supporter's residence status. If the supporter's situation changes, there is an obligation to notify immigration within 14 days (failure risks visa cancellation).

Common Mistakes & Pitfalls

Note that family members of Specified Skilled Worker 1 holders are not eligible for the family stay visa. Since SSW1 does not allow family accompaniment, switching to SSW2 or other statuses must be considered if family wants to join.
