Long-Term Resident Visa Strategy

Proving humanitarian considerations and family relationships

The Long-Term Resident visa is granted to foreign nationals with circumstances specially recognized by the Minister of Justice, with no work restrictions. Main targets include third-generation Japanese descendants, recognized refugees, former spouses of Japanese nationals or PRs after divorce, and children of Japanese nationals. Review varies greatly by individual circumstances, making specialist consultation particularly important.

Who this is for: Third-generation Japanese descendants, biological children of Japanese nationals or PRs, former spouses divorced from Japanese nationals or PRs, recognized refugees, and those recognized as needing humanitarian consideration.

Case-by-Case Review Points & Strategies

Case 1: Long-Term Resident Application After Divorce From Japanese National

Moderate

Situation

A holder of the Spouse of Japanese National visa divorces and wants to remain in Japan. They are the custodial parent of a child with Japanese nationality

Strategy

① Divorce certificate and proof of custody or visitation rights (mediation record, court order, etc.). ② Evidence of regular contact with the child (visitation records, photos). ③ Show a stable livelihood in Japan (income, housing).

Key Point: The interpretation that 'divorce without legitimate reasons does not qualify for Long-Term Resident' has been applied strictly. The track record of caring for and raising a Japanese child is the most important review point.

Case 2: Long-Term Resident Application for Third-Generation Japanese Descendant

Low Risk

Situation

A third-generation Japanese descendant from South America or elsewhere applies for a Long-Term Resident visa to work and settle in Japan

Strategy

Gather documents proving Japanese lineage (chain of family registers, passports, and birth certificates from grandparents and parents). Documents issued abroad require Japanese translation and notarization. Community certificates from Japanese descent organizations are also valid as supplements.

Key Point: Being a 'direct lineal descendant' is required for Japanese third-generation status. Adoptees and non-marital children require additional proof. Spouses and children can also apply for Long-Term Resident status simultaneously (the spouse need not be of Japanese descent).

Common Mistakes & Pitfalls

1

At each renewal, whether 'legitimate reasons' remain is re-examined. Properly paying taxes, pension, and health insurance while remaining in Japan as a Long-Term Resident is a prerequisite for continued renewal.
